1. About SmarTrip

SmarTrip ("we," "us," or "our") operates the website smartrip.me and provides an AI-powered trip planning service. SmarTrip generates personalized travel itineraries — including flights, hotels, activities, restaurants, and transport — optimized to fit within a user-specified budget.

SmarTrip is a planning and recommendation tool, not a travel agency, tour operator, or booking platform. We do not sell travel services directly. All bookings are completed through third-party partner websites.

2. Acceptance of Terms

By accessing or using SmarTrip, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. We reserve the right to update these terms at any time. Continued use of the service after changes constitutes acceptance of the updated terms.

3. Service Description

SmarTrip provides the following services:

  • AI-generated travel itineraries based on user preferences and budget
  • Price estimates for flights, hotels, activities, restaurants, and transport
  • Links to third-party booking partners for completing reservations
  • Trip management tools including saving and viewing generated plans

4. Important Disclaimers

4.1 Price Estimates

All prices shown in SmarTrip itineraries are AI-generated estimatesbased on historical data and market patterns. Actual prices on booking partner websites may differ. SmarTrip does not guarantee the accuracy, availability, or finality of any price displayed. Always verify the final price on the booking partner's website before completing a purchase.

4.2 Third-Party Bookings

When you click a booking link in your itinerary, you are redirected to a third-party website (such as Booking.com, Skyscanner, GetYourGuide, or similar). Your booking, payment, cancellation, and refund are governed entirely by that third party's terms and conditions. SmarTrip is not a party to any transaction you complete with a third-party provider.

4.3 AI-Generated Content

Itineraries, restaurant recommendations, activity descriptions, and other content are generated by artificial intelligence. While we strive for accuracy, AI-generated content may contain errors, outdated information, or inaccuracies. We recommend verifying important details (opening hours, visa requirements, safety advisories) through official sources before traveling.

4.4 Budget Guarantee

SmarTrip's budget optimization aims to generate plans that come in below your stated budget. This is a planning estimate, not a financial guarantee. Actual costs may vary based on real-time pricing, availability, currency fluctuations, and booking timing.

5. User Accounts

You may create an account using Google OAuth or email registration. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to update it as needed. We reserve the right to suspend or terminate accounts that violate these terms.

6. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to reverse-engineer, scrape, or automate access to the service
  • Overload the service with excessive requests (rate limits apply)
  • Impersonate another person or entity
  • Use the service to generate content that is harmful, misleading, or abusive

7. Intellectual Property

The SmarTrip name, logo, website design, and underlying technology are owned by SmarTrip. AI-generated itineraries are provided for your personal use. You may share your trip plans with others but may not resell or commercially redistribute them.

8. Limitation of Liability

SmarTrip is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, SmarTrip shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to: missed flights, incorrect bookings, price discrepancies, travel disruptions, or reliance on AI-generated recommendations.

Our total liability for any claim arising from the service shall not exceed the amount you paid to SmarTrip in the 12 months preceding the claim (which, for free users, is zero).

9. Affiliate Relationships

SmarTrip participates in affiliate marketing programs. When you book through links in your itinerary, we may receive a commission from the booking partner at no additional cost to you. This does not influence the AI's recommendations — our algorithm optimizes for your preferences and budget, not for commission rates.

10. Termination

You may delete your account at any time. We may suspend or terminate your access to the service at our discretion if you violate these terms. Upon termination, your saved trip data will be deleted within 30 days.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Israel. Any disputes arising from these terms or your use of SmarTrip shall be subject to the exclusive jurisdiction of the courts of Tel Aviv, Israel.
