Terms of Service

1. Acceptance of Terms

By accessing or using TripWise (“the Service”), operated by TripWise (“we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree to all terms, do not use the Service.

2. Description of Service

TripWise is an AI-powered travel planning platform that generates personalized travel itineraries based on user inputs including budget, destination, dates, and preferences. The Service may facilitate bookings with third-party travel providers (airlines, hotels, activity operators), though TripWise is not itself a travel agent or booking platform.

3. User Accounts

You must create an account to access most features. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and make bookings.

4. AI-Generated Content

Trip itineraries, budget estimates, hotel recommendations, and other content are generated by AI and are provided for informational purposes only. While we strive for accuracy, AI-generated content may contain errors or outdated information. You should independently verify all pricing, availability, visa requirements, and travel advisories before making any bookings or travel decisions.

TripWise does not guarantee that AI-generated itineraries will match your preferences exactly or that all suggested options will be available at the quoted prices.

5. Bookings and Payments

When you book travel through TripWise, you are entering into a contract directly with the relevant third-party provider (airline, hotel, tour operator). TripWise facilitates the booking process but is not a party to the booking contract.

All prices displayed are estimates based on availability at the time of itinerary generation. Actual prices at the time of booking may differ. We are not responsible for price changes between itinerary generation and the time of booking.

Payments are processed by Stripe. By making a payment, you agree to Stripe's terms of service. TripWise does not store your full payment card details.

6. Cancellations and Refunds

Cancellation and refund policies are determined by each individual travel provider. TripWise cannot guarantee refunds for any booking made through the platform. You should review the cancellation policy of each provider before booking.

7. Prohibited Uses

You may not use TripWise to:

  • Violate any applicable laws or regulations
  • Submit false, misleading, or fraudulent information
  • Attempt to gain unauthorized access to our systems
  • Scrape, crawl, or harvest data from the Service without permission
  • Use the Service for any commercial purpose without our prior written consent
  • Interfere with or disrupt the integrity or performance of the Service

8. Intellectual Property

The TripWise platform, including its design, code, and AI models, is owned by TripWise and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

Trip itineraries generated for your personal use remain your property. You grant us a non-exclusive license to use anonymized versions of your trip data to improve our Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPWISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim arising under these terms shall not exceed the amount you paid to TripWise in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless TripWise and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the applicable jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
